Terms of Service

1. Agreement to Terms

By accessing or using Agent0 ("the Service"), operated by MarkOps ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Agent0 provides an AI-powered productivity framework that includes a vault configurator, agent-driven workflows, and related tools. The Service includes both free features (Build Your Second Brain) and paid offerings (the Agent0 Framework).

3. Account Registration

Some features require you to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes. You must be at least 18 years old to use the Service.

4. Purchases and Payments

Paid features are processed through Stripe. All purchases are one-time payments unless otherwise stated. Prices are listed in USD and are subject to change with reasonable notice. You agree to pay all fees associated with your purchase.

5. Refund Policy

Due to the digital nature of the product, all sales are final. If you experience a technical issue that prevents you from accessing your purchase, contact us at maciek@markops.ai within 14 days of purchase and we will work to resolve it or issue a refund at our discretion.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Redistribute, resell, or sublicense the Framework or any paid content without written permission
• Use automated tools to scrape, crawl, or extract data from the Service beyond normal use
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or its related systems

7. Intellectual Property

All content, features, and functionality of the Service are owned by MarkOps and are protected by copyright, trademark, and other intellectual property laws. The Agent0 Framework license grants you a personal, non-transferable right to use the framework for your own projects. You may not redistribute the framework itself.

8. User Content

You retain ownership of any content you create using the Service (vault structures, configurations, notes). We do not claim ownership of your content. By using the Build Your Second Brain feature, you grant us permission to process your input through AI to generate your vault configuration.

9. AI-Generated Content

Parts of the Service use artificial intelligence to generate content and recommendations. AI-generated outputs are provided "as is" without guarantees of accuracy, completeness, or fitness for any particular purpose. You are responsible for reviewing and validating any AI-generated content before relying on it.

10. Limitation of Liability

To the maximum extent permitted by law, MarkOps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, without prior notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Quebec.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
